Welcome to TunoStore. By accessing or using our platform, you agree to comply with and be bound by the following terms and conditions (“Terms”). Please read them carefully before using our services.

1. Introduction

TunoStore (“we,” “us,” or “our”) operates the website tunostore.com and related mobile applications (collectively, the “Platform”). These Terms govern your use of the Platform and the services offered therein.

2. Acceptance of Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use the Platform.

3. Account Registration

To access certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password confidential and secure.
  • Accept responsibility for all activities that occur under your account.

4. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not:

  • Violate any applicable laws or regulations.
  • Infringe upon or misappropriate any intellectual property rights.
  • Transmit any harmful or malicious code.
  • Engage in any activity that could damage or impair the Platform’s functionality.

All content on the Platform, including text, graphics, logos, and software, is the property of TunoStore or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

6. Disclaimers

You acknowledge and undertake that you are accessing the services on the TunoStore Platform and transacting at your own risk, using your best and prudent judgment before entering into any transactions. TunoStore strives to display product information, including color, size, shape, and appearance, as accurately as possible. However, actual product attributes may vary due to device display settings and other factors.

TunoStore does not make any representation or warranties regarding the products available on the Platform, including their availability, usability, or fitness for a particular purpose. We accept no liability for any errors, inaccuracies, or omissions in product information provided by third-party sellers.

7. Limitation of Liability

To the fullest extent permitted by law, TunoStore shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Platform.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any interruption or cessation of transmission to or from the Platform.
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Platform by any third party.
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Platform.

8. Indemnification

You agree to indemnify, defend, and hold harmless TunoStore, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with:

  • Your access to or use of the Platform.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property or privacy rights.

9. Modifications to the Terms

TunoStore reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Kanpur, Uttar Pradesh, India.

Refund and Cashback Policy

1. Order Cancellation

You acknowledge that: (a) Your cancellation, attempted or purported cancellation of an order, or (b) Cancellation due to reasons not attributable to TunoStore, shall amount to a breach of these Terms. Any such cancellation request shall be permitted subject to TunoStore’s acceptance.

For any permitted cancellations, we will initiate a refund, if applicable, against the relevant product/order. Refunds may be issued in the form of promotional codes, coupons, or store credits, which can be used for future transactions on the TunoStore Platform, subject to validity and applicable terms.

Orders may be canceled by TunoStore under the following circumstances:

  • Suspected fraudulent transactions.
  • Non-compliance with the Terms of Use.
  • Unavailability of products.
  • Any external factors outside TunoStore’s control, including logistical issues.

For such cancellations, TunoStore will initiate a refund within approximately 72 hours.

2. Returns and Refunds

Products once delivered are non-returnable, non-replaceable, and non-exchangeable, except in the following cases:

  • If the product is damaged, defective, expired at the time of delivery, or incorrectly delivered.
  • If the product has a return/exchange policy explicitly mentioned at the time of purchase.

All return/exchange requests must be made within the specified timeframe outlined in the return policy of the respective product.

For digital goods (including gift cards/vouchers), no return or refund is applicable. Customers must reach out to the respective issuer/seller in case of any issues related to validity, usage restrictions, or redemption.

Refunds for permitted returns or cancellations will be processed within 7 working days from the date of approval, subject to verification.

  • For payments made through electronic means (credit/debit cards, net banking, UPI), refunds will be credited to the original payment method or in the form of store credits/coupons.
  • Refunds for cash-on-delivery (COD) purchases will be issued as store credits or promotional codes, which will expire within 30 days from the date of issuance.
  • Refunds cannot be transferred back to any other payment method once issued as store credit or coupons.

All refunds shall be issued in Indian Rupees only.

3. Cashback Policy

The following terms apply to cashback offers on the TunoStore Platform:

  • Cashback refers to credit granted for eligible transactions, which will reflect in the user’s account. It does not imply a direct refund to a bank account or cash withdrawal.
  • Cashback can be either transactional (earned through purchases) or promotional (as part of marketing campaigns).
  • Orders that are canceled will not be eligible for cashback. Any cashback received for a refunded order will be adjusted accordingly.
  • TunoStore reserves the right to withdraw, suspend, amend, or cancel cashback offers without prior notice.
  • Cashback for eligible orders will be credited within 24-48 hours, but in some cases, it may take up to 7 working days post-delivery.
  • Transactional cashback will expire within 90 days from the date of credit, while promotional cashback will expire within 60 days, unless stated otherwise.
  • Cashback and discount codes may not be applicable to certain products/services, as determined by TunoStore.

Third-Party Services

These terms are supplementary to and do not replace any other terms governing the use of the TunoStore Platform.

TunoStore may collaborate with third-party service providers to enhance customer experience. Users may have the option to avail of such services via the TunoStore Platform or as part of a product package.

Services offered by third-party providers are solely their responsibility and are governed by their terms and conditions. TunoStore has no control over order fulfillment, customer support, or grievance redressal related to these services.

By opting for such services, users consent to share their personal and order details with third-party providers. Personal data shared will be subject to the third party’s privacy policy.

TunoStore does not guarantee or warrant the quality, reliability, or suitability of third-party services.

Users avail of such services at their own risk, and TunoStore is not liable for any actions or omissions of third-party service providers.

TunoStore will not mediate disputes between users and third-party service providers.

Purchase of Cigarettes, Tobacco Products, Hookah, Rolling Papers, and Nicotine Products

Users agree and undertake that:

  • They are at least eighteen (18) years of age.
  • They reside outside a 100-yard radius from any educational institution.
  • Users will not use the TunoStore Platform to purchase tobacco products if they do not meet the legal age requirement or if they reside within the restricted area.
  • If a user is found to have misrepresented their age or location, TunoStore reserves the right to take appropriate action.

Promotional Terms

  • Offers run for a specified duration at TunoStore’s discretion and may be withdrawn without prior notice.
  • If an offer is linked to a minimum order value or specific product category, it will be canceled if the order is returned, refunded, or canceled.
  • TunoStore is not responsible for third-party services availed as part of an offer.
  • Users consent to TunoStore sharing their details with authorized third parties for offer fulfillment.
  • Offers are valid only for accounts and billing addresses set in India.
  • Offers cannot be sold, transferred, encashed, or combined with other offers.
  • TunoStore reserves the right to disqualify users from offers in cases of breach of terms, fraudulent activity, or disruptive behavior.
  • TunoStore is not liable for any loss or misuse of offers.

Payments Facility and Related Information

  • Payments must be made in Indian Rupees.
  • Available payment methods will be displayed at checkout and may include credit/debit cards, net banking, UPI, or cash on delivery (subject to availability).
  • TunoStore uses third-party vendors for payment processing and is not liable for their terms and conditions.
  • Users must ensure they are authorized to use the payment methods they provide.
  • The payment facility provided by TunoStore is a facilitation service and not a banking or financial service.
  • Additional transaction fees may apply depending on the payment method.

Order History

  • If a user deletes an order from their order history, it will no longer be visible or accessible to them.
  • Deleted orders will remain in TunoStore’s records as per its Privacy Policy and applicable laws.
  • TunoStore will not provide support for deleted orders, including complaints, retrieval requests, cancellations, returns, or exchanges.
  • Deleted order details may still be visible due to external factors such as payment records, email notifications, or third-party interactions.

International Users

These terms apply to users registered on the TunoStore Platform with an international mobile number.

  • To place an order, users must provide the recipient’s details, including a registered Indian phone number and address.
  • Deliveries are limited to select locations in India.
  • Certain features may not be available to International Users.
  • Services and product availability may be restricted for International Users.
  • Payments can be made using international cards and other approved methods displayed at checkout.
  • Additional charges, including foreign currency conversion fees, may apply and will be borne by the user.
  • Cash on delivery is not available for International Users.

By using the TunoStore Platform, users acknowledge and agree to abide by these terms and any updates TunoStore may introduce.

Grievance Redressal Mechanism

For any order-related issue, you may first reach out to us via chat support on the Platform for real-time resolution.

In accordance with applicable law, including the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Consumer Protection Act, 2019, and the Consumer Protection (E-Commerce) Rules, 2020, the name and contact details of the Grievance Officer and Nodal Officer who can be contacted for any complaints or concerns pertaining to the Platform, including those related to breaches of the Terms or any other policies, are provided below:

Indemnity

Notwithstanding anything to the contrary, you agree to indemnify, defend, and hold harmless the Company and its affiliates from and against any third-party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) arising as a result of, or in connection with:
(a) Your content or comments;
(b) Your unauthorized use of the Platform/Services, or products or services included or advertised in the Services;
(c) Your access to and use of the Services;
(d) Your violation of any rights of another party; or
(e) Your breach of these Terms (including Privacy Policy and any infringement by you of the intellectual property rights of any third party) and/or applicable law.

We retain the exclusive right to settle, compromise, and pay any claims or causes of action brought against us without your prior consent. You agree not to settle any matter in which we are named as a defendant or for which you have indemnity obligations without our prior written consent.

Limitation of Liability

Notwithstanding anything to the contrary:

  1. The Company shall not be liable for any claims, damages, or losses to the customer or any other person except as established by a non-appealable order of a court of competent jurisdiction.
  2. Subject to the above, the maximum aggregate liability of the Company shall in no event exceed the refund of the money charged for purchases made pursuant to the relevant order with respect to which liability has arisen and been established.
  3. The Company shall not be liable under any circumstances for any indirect, special, consequential, exemplary, punitive, or incidental losses or damages, including but not limited to loss of profit, reputation, or business opportunities.
  4. Any legal action against the Company must be commenced within one (1) year after the alleged harm initially occurs. Failure to commence the action within that period shall forever bar any claims or causes of action.

Termination

The Company, at its sole discretion and without liability, reserves the right to terminate or restrict your access to the Platform/Services without notice, including but not limited to circumstances where:

(a) You do not meet or violate the eligibility criteria;
(b) You are in breach of these Terms (including Privacy Policy).

We may deactivate or delete your account and related information. If you use the Services in violation of these Terms, we may retain all data collected from your use of the Services. You may delete your account at any time via the Platform. Your personal data will be processed in accordance with our Privacy Policy.

Certain rights, such as indemnity obligations and governing law provisions, shall survive termination. Any termination shall not waive obligations to pay for already ordered/availed products/services.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Courts at Kanpur, Uttar Pradesh shall have exclusive jurisdiction over any disputes arising under these Terms.

Terms and Conditions for EMI on Credit and Debit Cards

The following terms and conditions (“EMI Terms”) apply to all transactions made using the Equated Monthly Installments (“EMI”) facility on TunoStore’s website and mobile application (“Marketplace”). These EMI Terms are supplementary to and do not replace any other terms governing the use or access of the Marketplace. By opting for the EMI facility, customers (“You”) agree to be bound by these EMI Terms.

  1. You may opt for the EMI payment method on purchases that meet the minimum value criteria set by the issuing bank, subject to the availability of the EMI facility from your issuing bank.
  2. The EMI facility is not available for purchases made using UPI, net banking, prepaid payment instruments, buy now pay later options, or cash on delivery methods.
  3. You may combine multiple products from third-party sellers or brands on the Marketplace into a single purchase and convert it into an EMI transaction.
  4. The EMI facility is offered by respective issuing banks, and TunoStore has no role in approval, extension, pricing (including applicable taxes), modification, pre-closure, closure, repayment, or any other aspect of the EMI facility.
  5. You agree to be governed by the terms and conditions of the issuing bank and must contact the bank directly for any complaints, disputes, or inquiries regarding EMI transactions.
  6. TunoStore displays representative EMI-related information on a best-effort basis based on details shared by the issuing banks. The issuing banks are the authoritative sources of EMI information, and you should contact them for any clarifications.
  7. If you cancel an order before the issuing bank processes it as an EMI, you will receive a full refund. However, if the order is canceled after EMI processing, applicable fees and taxes imposed by the bank will not be refunded.
  8. You are responsible for paying the total order value at the time of payment using a debit or credit card. The issuing bank will then convert this payment into EMI according to its policies.
  9. TunoStore does not charge any processing or convenience fees for facilitating the EMI facility.
  10. TunoStore reserves the right to discontinue or modify the EMI facility without prior notice.
  11. Any specific terms related to the issuing bank’s EMI offer will be provided to you at the time of availing the facility via push notifications, hyperlinks, SMS, email, or other written formats.
  12. TunoStore merely facilitates EMI options provided by banks and shall not be responsible for any aspect of EMI-related transactions, including restructuring, refund/return, foreclosure, etc.

Terms and Conditions for No-Cost EMI on Credit Cards (“Offer”)

  1. By availing this Offer, you will receive an upfront discount equivalent to the EMI interest charged by the issuing bank, making it a no-interest-cost EMI.
  2. Applicable taxes on interest and any other charges related to this Offer will be levied by the issuing bank.
  3. The discount applies only if you opt for the “No-Cost EMI on Credit Card” option.
  4. The Offer is not a waiver of EMI interest by the issuing bank.
  5. The Offer may not be available on all products listed on the Marketplace.
  6. The Offer is subject to the discretion and directions of the issuing bank.
  7. TunoStore has no obligation or liability if the bank refuses or fails to process the Offer.
  8. Failure to make timely EMI payments to the issuing bank may result in additional interest or penalties higher than the discount under this Offer. TunoStore is not responsible for non-payment or delayed payments.
  9. In case of returns or refunds, interest already billed for a transaction will not be refunded.
  10. The issuing bank may charge processing or cancellation fees, which you agree to bear.
  11. TunoStore reserves the right to modify or cancel the Offer at any time due to changes made by third-party sellers or brands extending the Offer.

Miscellaneous

  1. Interpretation: Section and subject headings in these Terms are for reference only and shall not affect the interpretation of provisions.
  2. Entire Agreement and Waiver: These Terms, along with the Privacy Policy, constitute the entire agreement between you and TunoStore concerning the Services. Any failure or delay by TunoStore in exercising a right does not constitute a waiver of such right.
  3. Severability: If any provision of these Terms is deemed unlawful, invalid, or unenforceable by a judicial court, that provision shall be severed, and the remaining Terms shall continue in full force.
  4. Partnership or Agency: These Terms do not constitute a partnership or agency between you and TunoStore, and you have no authority to bind TunoStore in any manner.

By using the EMI facility on TunoStore, you acknowledge and agree to abide by these terms and any updates introduced by TunoStore or the issuing bank.
